General Terms and Conditions
1. General
1.1 These General Terms & Conditions (hereinafter "GTC") shall apply to the business relationship between Bohdan Bondarenko (hereinafter "Retailer") and its Customers. A customer is a natural or legal person ordering goods or services (hereinafter "Goods") from the Retailer. Customers can be consumers or businesses. The Retailer herewith objects to the Customer's own Terms & Conditions, unless otherwise agreed upon explicitly in writing. These GTC can be viewed, saved and printed on the Retailer's online shop (hereinafter "Webshop") and they are also automatically included in the Retailer's order confirmations as amended from time to time.
1.2 For the purpose of these GTC, a consumer is defined as a natural person entering into a contract for purposes predominantly not attributable to his commercial activities. For the purpose of these GTC, a business is defined as a natural or legal person or a partnership with legal capacity entering into a contract exercising its commercial activities.
1.3 The Retailer's associates are prohibited from offering terms deviating from these GTC. Any oral agreements only have legal effect if confirmed in writing by the Retailer.
1.4 Wherever used herein, a pronoun in the masculine gender shall be considered as including the masculine and feminine gender.

2. Online Contracts/Distance Transactions
2.1 The product descriptions in the Webshop can be both firm offers (Goods ready for sale) and not firm offers, but serve as a basis for firm offers by the Customer (Goods for preorder).
2.2 The Customer may submit his offer through the online order forms integrated in the Webshop (general custom shop forms or preorder forms for specific model). After having selected the specific Goods with their specifications and passed though the electronic order process, by clicking on the button concluding the order process, the Customer submits a binding offer with respect to the selected Goods. Alternatively, the Customer may also submit his offer by e-mail or other electronic means of communication (e.g. via Instagram direct messages, etc.).
2.3. The Customer may also submit his offer regarding the purchase of Goods that are ready for sale using purchase forms on other websites used by the Retailer (e.g. Reverb, Willhaben, etc.).
2.3 After receipt of the order by the Retailer, the Customer will receive a confirmation of receipt. This confirmation does not represent an order acceptance. A contract will only be concluded if and when the Retailer explicitly expresses his acceptance or dispatches the Goods without explicit declaration of acceptance.
2.4 Any product specifications which are not stipulated in writing will be executed in customary manner. No cancellation right can arise in this connection.
2.5 The Retailer reserves the right to commonly occurring and reasonable deviations of dimensions, weights, colours, materials and textures between individual specimens, between production batches, and from electronic or printed images and descriptions in the Webshop and on social media. The Retailer reserves the right to modify the Bond Guitars logo without notice.
2.6 The Retailer reserves the right not to enter into a contract or cancel a contract without giving any reasons or not to deliver Goods for productional or logistical reasons or without giving any reasons. Any payments made before by the Customer will be retransferred to the Customer. Any further claims from the Customer are herewith excluded. The Customer has no right to request build modifications after contract conclusion. The Retailer may at his own discretion request additional consideration for modifying build specifications after contract conclusion. If the Customer wishes to cancel the contract or insists on modifications leading to cancellation on the part of the Retailer, a minimum of 50% of the contract value will remain with the Retailer. In cases where the Retailer incurs costs due to the Customer disregarding information provided by the Retailer, the Retailer is entitled to reclaim such costs plus adequate administrative charges.
2.7 The usual contract languages are German and English. For legal purposes the English text shall have priority of interpretation.
2.8 As a rule, orders are processed via e-mail. The Customer shall ensure to provide a correct e-mail address and set any spam filters in such a way that e-mails of the Retailer or third parties involved in the order process can be delivered.
2.9 The Customer acknowledges that the Retailer may use pictures, videos or sound files of a Good including individual content, such as artwork provided by the Customer, as well as the wording of the Customer's feedback in an anonymized form, for marketing purposes and may rebuild a custom design without consideration.
2.10 Communicated delivery times or delivery periods serve indicative informational purposes without engagement. Custom manufactures can be subject to unforeseeable imponderables. No cancellation right can arise from late delivery of up to one year.

3. Cancellation Right

Easy Cancellation Instructions

A) Send us an e-mail to sales@bondguitars.com.ua saying you wish to return your purchase (cancellation notice). We don't ask you for a reason but kindly make sure we get the complete picture (use the cancellation form below or just reply to our initial receipt confirmation which includes your order details).
B) Wrap the instrument, accessories and all packaging kit (including documents) up in its original packaging.
C.a) EU CUSTOMERS who bought an INSTRUMENT IN STOCK: we refund 100% of your instrument price less all shipping costs. We will not charge any handling fee. You kindly arrange for trackable return shipping to Bohdan Bondarenko, Linzer Straße 183/12, 1140 Vienna, Austria (+436764385512) at your own cost and risk. Any other address is unsuitable for package recipience and return shipments will not be accepted.
C.b) NON-EU CUSTOMERS who bought an INSTRUMENT IN STOCK: we refund 100% of your instrument price less all shipping costs, customs and import/export charges. We will not charge any handling fee. You kindly arrange for trackable return shipping to Bohdan Bondarenko, Linzer Straße 183/12, 1140 Vienna, Austria (+436764385512) at your own cost and risk. Any other address is unsuitable for package recipience and return shipments will not be accepted.
D) Post the parcel within 14 days after your cancellation notice. The instrument will be considered returned after it has safely reached us and passed our damage inspection.
E) You will be refunded via the same payment method that you used when making the purchase.
F) Any other category of instruments, such as BOND CUSTOM SHOP or BOND PREORDER instruments, are not subject to these Easy Cancellation Instructions but considered Goods made or modified according to Customer specifications according to the General Cancellation Right below. In the event of promotional free shipping, regular shipping rates shall be used for cancellation calculations.
To the extent that this voluntary return policy exceeds the general cancellation right, it is limited to one instrument at the time per customer.

General Cancellation Right

3.1. Consumers resident in the EU are entitled to a cancellation right of contracts, if such contracts come about exclusively through means of telecommunication. The cancellation period is fourteen days from the day the Customer or his substitute recipient receives the Goods. In order to exercise his cancellation right, the Customer shall explicitly inform the Retailer by e-mail to sales@bondguitars.com.ua about his decision to revoke the contract, giving all the information as specified in the below cancellation form.
3.2. In case of a cancellation the Customer shall resend the Goods to the Retailer at Bohdan Bondarenko, Linzer Straße 183/12, 1140 Vienna, Austria (+436764385512) within fourteen days from the day of the declaration of cancellation. Any other address is unsuitable for package recipience and return shipments will not be accepted. The Customer shall incur any decrease in value of the goods only if such decrease is owed to treating the Goods in a way not necessary for inspecting the state, properties and functioning of the Goods. Such acceptable inspecting shall not include disassembling and reassembling, drilling of holes or other alterations. The Customer is asked to resend the goods in their original state and packaging including all packaging components in order to avoid damage claims concerning shipping damages due to inadequate packaging.
3.3. However, the Сonsumer has no such cancellation right in cases of Goods made or modified according to Customer specifications (BOND CUSTOM SHOP or BOND PREORDER instruments) as such goods are considered being goods made to order or clearly personalised under EU rules and Austrian legislation.

3.5. The Retailer offers a voluntary return policy as laid down in the above Easy Cancellation Instructions, notwithstanding the general cancellation right as stated in the above articles. To the extent that this voluntary return policy exceeds the general cancellation right above, it is limited to one instrument at the time per customer, valid until further notice and subject to order refusal at the Retailer's discretion.

4. Prices and Terms of Payment
4.1 Unless otherwise specified in the Webshop's product description, prices are indicated as Total Price without shipment costs. These prices does not include VAT according to §6 para. 1 line 27 UStG 1994. Shipment and payment costs shall be quoted separately in the order process, if applicable.
4.2 In case of shipments outside the EU, additional costs may have to be incurred by the Customer. Such costs may include payment fees (e.g. for money transfers and currency exchange) or import related fees (e.g. customs duties and import taxes). Payment fees may also arise for shipments within the EU, if payment originates from a country outside the EU. Please note that if you choose to pay for your order using PayPal, we have to charge up to extra 5.39% + 0.35 EUR due to PayPal’s commission policy. The exact amount will be specified at the time of choosing a payment method.
4.3 In case of delay in payment, the Customer undertakes to reimburse expenses necessary for dunning and collection including but not limited to legal expenses and pay default interest at a rate of 9% p. a. This shall not affect default interest for businesses as required by law. In case of payment by direct debit, the Customer shall incur any costs which may arise for rescinding of a payment transaction due to insufficient funds or incorrectly specified bank details.
4.4 In case a Customer is late in payments, suspends payments or insolvency proceedings are initiated, the entire remaining dept shall fall due.
4.5 Discount offers, such as coupon codes, bundles or other promotional price reductions, are generally mutually exclusive and cannot be applied cumulatively unless explicitly otherwise specified in writing.
4.6 In case of payment in instalments, deposits made by a Customer are generally used for sourcing, drawing, production and administrative expenses related to the customer order and are therefore non-refundable.

5. Shipment and Delivery
5.1 The Goods shall be shipped to the delivery address provided by the Customer in the order process.
5.2 In case the shipping company returns the Goods to the Retailer due to impossible delivery, the Customer shall incur the costs of the failed shipment and return shipment.
5.3 If the Customer acts in his business capacity, the risk of accidental loss and accidental deterioration of the Goods is transferred to the Customer as soon as the Retailer hands over the goods to the shipping company. If the Customer is a consumer, the risk of accidental loss and accidental deterioration of the Goods is as a rule transferred to the Customer only when the goods are handed over to the Customer or his authorized substitute recipient.
5.4 The Retailer commissions shipping companies to transport the Goods to the Customer. The Retailer assumes no responsibility for the duration of transport.

6. Reservation of Ownership Title
6.1. The Retailer reserves his ownership rights in the delivered Goods until complete payment of the owed purchase price. Prior to complete payment, the goods may neither be assigned to third parties nor as security.
6.2. In case of adding promotional terms in the contract between Retailer and the Customer the Retailer reserves his ownership rights in the delivered Goods until complete payment of the owed purchase price and fulfillment of advertising obligations mentioned in the contract.

7. Warranty
7.1 The Retailer guarantees that Customer’s instrument has no defects in materials and workmanship. Warranty is valid for one year from the date of purchase. This warranty is only valid for instruments purchased directly from the Retailer or from his official distributor. Guarantee applies only to the first buyer of the guitar, whose information is specified in the Warranty Certificate. If the guitar requires warranty repair or service, just contact the Retailer or authorized dealer from whom the instrument was purchased.
7.2 However, if the Customer is a business, minor defects do not as a rule constitute warranty claims, the Retailer has the right to choose the remedy and the statute of limitations does not restart if the Goods are substituted by way of warranty liability.
7.3 In case of apparent transport damage, the Customer is asked to complain immediately to the deliverer and inform the Retailer.
7.4 In case the Customer accepts the Goods despite his knowledge of a defect, he is only entitled to warranty claims, if he reserves such claims explicitly by e-mail to the Retailer immediately upon receipt of the Goods.
7.5 The Customer is advised that he may be required to carry out cleaning and maintenance work.
Lacquered wood surfaces are best cleaned with a soft cotton cloth, damped with water or mild hand soap. Under no circumstances shall the Customer attempt to use alcohol, acetone, white gas or any other aggressive substances.
The unlacquered surface of fretboard wood is best cleaned and hydrated with dedicated fretboard oil obtained from specialized suppliers. The Retailer can recommend such suppliers upon request.
To remove dust from hard-to-reach hardware corners, the Retailer recommends using a vacuum cleaner with a dust brush. Black hardware tends to loose its gloss over time.
Mounting and adjustment screws and nuts are to be checked periodically.
The Customer is herewith also advised of the necessity of adequate storage conditions for guitars. Please store and transport your guitar only in its gigbag or case. Protect it from:
  • high levels of environment humidity, high and low temperatures;
  • being close to heating devices, do not leave the guitar for a long time on a hot day in a car or in cold, damp rooms;
  • rapid changes in temperature. In winter, after the guitar gets into a warm room after being outside, leave it in a gigbag or case for a couple of hours;
  • exposure to direct sunlight for a long time.
Omitted or inappropriate maintenance work, inadequate storage and inappropriate handling can compromise the durability and functionality of the parts, without giving rise to claims against the Retailer.
7.6 Please note that the warranty does not cover the following cases:
  • any part of the guitar being scratched by regular wear and tear;
  • modifications, setups, scheduled maintenance of the guitar;
  • damage to the instrument due to force majeure and shipping;
  • damage to the guitar finish or cracks, splits, warping of the wood due to changes in temperature or humidity, exposure to the sun, fire, moisture, sweat, guitar straps, guitar stands, effects of chemicals on the guitar surface;
  • wearout of frets, saddles, nut, strings and batteries;
  • damage, corrosion or rust of any mechanical components caused by humidity, salty air or sweat;
  • scratches, change or loss of color, wear of the coating;
  • a guitar with a missing or damaged serial number;
  • a guitar that has been previously serviced not at a Retailer’s service center;
  • a guitar purchased not directly from Retailer or an official distributor.

8. Liability
The Retailer shall be liable to the Customer from all contractual, quasi-contractual and legal, and also delictual claims for compensation for damages and expenses as follows:
8.1 The Retailer is liable on whatever legal ground unrstricted in case of wilful intent or gross negligence as well as in case of intentional and negligent injury of life, body or health.
8.2 If the Retailer infringes negligently on a substantial contractual obligation, his liability is limited to the damage typical to the contract and predictable, insofar as he is not unlimitedly liable according to the preceding paragraph.
8.3 In all other cases, the Retailer's liability is excluded.

9. Indemnity
9.1 If the Customer commissions the Retailer to process the Goods according to customer specifications, the Customer has to ensure that his specifications and contents do not violate the rights of third parties and any laws, for example custom engravings or prints shall not violate intellectual property rights, personal or any other rights of third parties or prohibitive laws or be offensive in any other way. The Customer indemnifies and keeps the Retailer indemnified from and against any claims of third parties or penalties of government authorities or courts which they might assert against the Retailer in this connection. The Customer shall also incur any reasonable expenses of necessary legal defence including court and lawyer fees at statutory rates.
9.2 In case of claims against the Retailer, the Customer shall without delay, truthfully and completely provide the Retailer with all information necessary for examination of such claims and defence against them.

10. Governing Law and Place of Jurisdiction
10.1 Any legal relationships between the Parties shall be governed by Austrian law excluding the UN Convention on Contracts for the International Sale of Goods. If the Customer is a consumer, this choice of law is valid only to such extent as the protection is not revoked by mandatory regulations of the country where the consumer has his residence.
10.2 The place of jurisdiction shall be where the Retailer has his registered office.
11. Severability Clause11.1 In case any provision in these General terms shall be held invalid, illegal or unenforceable, the validity, legality and enforceability of the remaining provisions shall not in any way be affected or impaired thereby.
